Adding your name on orkut.com is simple, and so are the rules that come with it. The following terms describe the rules and conditions for using orkut.com, what signing means, who can sign, and how your code and supporter card work.
Using the orkut.com site and/or any materials made available on the site indicates that you have both read and accepted these terms. If you don’t agree with these terms, you may not use the site or any materials.
This site is run by Orkut, Inc., 2 Mint Plaza #1004, San Francisco, CA 94103. You can reach us at info@orkut.com.
A website where you can explore Orkut’s articles and other materials and add your name to say you’d like Orkut to create a new social network focused on authentic people, real connection, and genuine belonging. It is not a petition, and it isn’t addressed to any government, agency or company — only to us. By adding your name you’re telling us you want this built. That’s all it does.
Adding your name doesn’t reserve you a username, an account, or a place in line. It doesn’t create an account, and it doesn’t entitle you to anything.
If you’re under 18, don’t add your name. If you don’t have the consent of a parent or guardian, don’t use the site.
If you add your name we’ll show you a code. The code has no cash value, cannot be sold or transferred, and guarantees access to nothing. We may replace it with something equivalent. It expires six months after an Orkut product launches, or on 31 December 2027, whichever comes first. If we never launch, there will be nothing to redeem it against.
Your code is shown on screen once. We won’t email it to you and we can’t send it again later, so save it when you see it.
Giving a name is optional. If you give one, you’re allowing us to print it on your badge and to show it on this site next to your country. Don’t use someone else’s name, a name you don’t have the right to use, or anything offensive. We screen names and may decline to show one. Badges that have already been downloaded can’t be recalled.
Don’t submit entries by automated means, submit entries you aren’t entitled to make, attempt to inflate the count, or interfere with the site or the people using it. We may remove entries, cancel codes and block access where we believe this has happened.
The site, its text and images, the Orkut name and logo, and the articles and letter available on the site belong to Orkut, Inc. or the people who wrote them. So long as you follow these terms and conditions you may access and display the materials for your personal use while you are using the site. You may also share the badge as it is offered. Otherwise, you may not distribute, publicly display, publicly perform or otherwise use the materials outside the site, and you may not modify, edit, copy, reproduce, create derivative works of, reverse engineer, alter, enhance or in any way exploit the site or any of the materials from the site in any manner. The site also displays our trademarks, service marks, and logos and the trademarks, service marks and logos owned by others. You may not use any of these trademarks, service marks or logos without obtaining our written permission in advance.
This is a pre-launch campaign. Nothing here is a commitment to build, launch, or launch in any particular form, market or timeframe.
We offer this site as it is. We don’t guarantee it will always be available or error-free and we expressly disclaim all express and implied warranties of any kind, which includes any implied or statutory warranties of merchantability, fitness for a particular use or purpose, title, and non-infringement of intellectual property rights.
YOU ARE USING THE SITE AND THE MATERIALS ON THE SITE AT YOUR SOLE RISK. ORKUT WILL NOT BE LIABLE TO YOU FOR ANY DAMAGES RESULTING FROM YOUR DISPLAYING, COPYING, OR DOWNLOADING ANY MATERIALS TO OR FROM THE SITE OR YOUR USE OF THE SITE. IN NO EVENT WILL ORKUT BE LIABLE TO YOU FOR ANY INDIRECT, EXTRAORDINARY, EXEMPLARY, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, HOWEVER ARISING, EVEN IF WE KNOW THERE IS A POSSIBILITY OF SUCH DAMAGE. Nothing in these terms, however, limits any liability that can’t be limited by law.
If you give us your phone number and tick the box to grant your consent for us to do so, Orkut, Inc. may send you marketing messages about Orkut at that number, as described next to that box and in our Privacy Policy. You confirm the number is yours and that you are allowed to receive messages at it. If it changes or stops being yours, tell us at privacy@orkut.com so we do not message someone else. Standard carrier data charges may apply to such messaging and you are solely responsible for such charges. You can stop the messages at any time by replying STOP.
We may update these terms from time to time. If we do so, we’ll change the date below, and if a change is important we’ll say so on the page where you add your name. Using the site after we make such changes indicates that you have read and accepted them. If you do not accept the changed terms you must stop using the site.
Any comments, questions, suggestions or other feedback you provide to us through any communication (e.g., call, letter, fax, email) will be treated as both non-confidential and non-proprietary. By providing such feedback you give us an exclusive, transferable, worldwide, royalty-free, fully paid up license (including the right to sublicense) to use and exploit it as we may determine in our sole discretion. You understand and agree, however, that we are not obligated to use, display, reproduce, or distribute any ideas, know-how, concepts, or techniques contained in the feedback.
How we handle the information we receive from you through your use of the site is set out in our Privacy Policy.
These terms are governed by the laws of the State of California. We control and operate the site from our headquarters in the United States of America and the entirety of the site may not be appropriate or available for use in other locations. If you use the site (or any portion thereof) outside the United States of America, you are responsible for following applicable local laws. We prefer to advise you if we feel you are not complying with these terms and to recommend any necessary corrective action. However, certain violations of these terms, as determined by us, may result in immediate termination of your access to the site with or without prior notice to you. If any of these terms is found to be inconsistent with applicable law, then such terms shall be interpreted to reflect the intentions of the parties, and no other terms will be modified. Our failure to enforce any of these terms is not a waiver of such term. These terms are the entire agreement between you and Orkut, Inc. and supersede all prior or contemporaneous discussions or agreements between you and Orkut, Inc. about the site. The proprietary rights, disclaimers of warranties, limitations of liability and general provisions will survive any termination of these terms.
